Terms of Service
1. Scope
These Terms govern all purchases made via shop.agencyg.de. There are two sale channels: (i) products purchased via the "Shop on our Tebex Store" button are sold by Tebex Limited (UK) as merchant of record — Tebex's terms additionally apply; (ii) products purchased via the "Pay with PayPal" option in the shopping cart are sold directly by TDYSKY (Inhaberin: Nicole Rudolf, Die Halde 2, 64853 Otzberg, Germany; [email protected]). For (ii) TDYSKY is your contractual partner.
2. Formation of contract
Tebex channel: the contract is formed between you and Tebex Limited at the moment Tebex confirms your payment. PayPal cart channel: by clicking "Buy now (binding order)" you submit a binding offer to TDYSKY; the contract is formed when we send you the order confirmation email containing the Tebex gift card code (typically within seconds of the PayPal capture). The contract text is not stored in a customer-accessible form; the order confirmation email serves as your record.
3. Products
All products sold are digital goods — FiveM/GTA RP scripts (QBCore, ESX or standalone) delivered as encrypted resource files via the Cfx.re Keymaster, plus subscriptions to access bundled products. Specifications, screenshots and compatibility notes are listed on each product page; minor visual or non-functional variations between marketing material and the delivered resource do not affect the contract.
4. Prices and payment
All prices on the storefront are final end-prices in Euro — no surcharge is added at checkout. TDYSKY operates under the German small-business regulation (§19 UStG); no VAT is shown on direct PayPal cart sales. Where Tebex acts as merchant of record (Tebex store channel), Tebex shows and collects any applicable VAT on its side. The PayPal cart channel additionally allows display + charging in USD, GBP or CHF using daily ECB reference rates; the Tebex gift card delivered as part of that purchase is always denominated in EUR.
5. Delivery
Tebex channel: after successful payment, Tebex links the purchased resource to your Cfx.re account; you download the encrypted files from the Cfx.re Keymaster. PayPal cart channel: immediately after PayPal capture (typically within seconds), we generate a Tebex gift card via the Tebex Plugin API and email the code to the address you entered at checkout. You then redeem the code on our Tebex store to obtain the licensed scripts. Delivery is digital; no physical shipment.
6. Right of withdrawal
As a consumer in the EU, you have a statutory 14-day right to withdraw from a distance contract under §312g BGB (transposing Directive 2011/83/EU). This right is exercised by an unambiguous statement to TDYSKY (Inhaberin: Nicole Rudolf, Die Halde 2, 64853 Otzberg, Germany; [email protected]). The model withdrawal form is below. Exception for digital content (§356(5) BGB): the right of withdrawal expires when we begin performance of the contract, provided you (i) expressly consented to performance beginning before the withdrawal period ends, and (ii) acknowledged that this consent causes loss of the right of withdrawal. At PayPal checkout you tick a separate, unticked-by-default checkbox to give exactly this consent; for purchases on the Tebex store channel, the same applies under Tebex's terms. For non-digital cases (e.g. a refund agreement reached via support), refunds are processed within 14 days using the original payment method.
7. License
On full payment you receive a non-exclusive, non-transferable, single-buyer license to run the purchased script(s) on FiveM servers operated under the buyer's Cfx.re account. You may NOT redistribute, resell, share, leak, decompile, sublicense or open-source the files. Violation results in immediate license revocation and may trigger Cfx.re-side enforcement. The license is granted without time limit but ends if you breach these terms.
8. Subscriptions
Subscriptions (Business, Ultimate) are handled exclusively through the Tebex store channel; they are not available via the PayPal cart. Subscriptions renew monthly via Tebex until cancelled. You can cancel any time through your Tebex account; access continues until the end of the paid period and then ends.
9. Support
Support is provided in English and German via our Discord server (discord.gg/caBVda6nP9) and by email at [email protected]. Holders of the Business or Ultimate subscription receive prioritised support. Support covers installation guidance, bug reports for the latest released version, and reasonable usage questions; it does NOT cover modifying scripts for non-standard frameworks or third-party integrations beyond what is documented.
10. Online dispute resolution
The European Commission provides a platform for online dispute resolution (OS-Platform), accessible at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (§36 VSBG). 11. Applicable law
These terms and any contract formed under them are governed by the law of the Federal Republic of Germany, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers domiciled in the EU, this choice of law does not deprive them of the protection of mandatory provisions of the law of their habitual residence (Art. 6(2) Rome I).
